Terms of Use

1. Acceptance of Terms

By accessing or using the LeadDesk platform ("Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Eligibility

To purchase leads, you must be a licensed mortgage broker in good standing in the state(s) where you operate. LeadDesk reserves the right to verify licensure and deny or revoke access at any time.

3. Lead Data & FCRA Compliance

Leads purchased through LeadDesk include borrower-provided information: contact details, self-reported estimated credit score range, loan purpose, loan amount, property value, and address. No credit bureau data is included. By purchasing a lead, you certify that you intend to contact the borrower in connection with a legitimate mortgage inquiry and will honor their consent and any opt-out requests promptly.

You agree not to:

• Resell, sublicense, or transfer lead data to third parties not involved in the same credit transaction
• Use lead data for any purpose other than mortgage origination
• Retain consumer credit data beyond the period necessary for the transaction

4. TCPA Compliance

All borrowers on LeadDesk have provided explicit written consent to be contacted by phone, email, or text regarding mortgage options. However, you remain independently responsible for compliance with the Telephone Consumer Protection Act (TCPA), including maintaining your own do-not-call procedures and honoring opt-out requests promptly.

5. No Refunds

All lead purchases are final. LeadDesk does not guarantee conversion rates, borrower responsiveness, or loan closing. Credits may be issued at LeadDesk's sole discretion in the event of a documented data error.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility. Notify us immediately at security@leaddesk.com if you suspect unauthorized access.

7. Prohibited Conduct

You agree not to scrape, reverse-engineer, or systematically download the LeadDesk platform; submit false licensure information; or use the Service to harass, defraud, or harm consumers.

8. Limitation of Liability

LeadDesk's liability for any claim arising from use of the Service is limited to the amount paid for the specific lead(s) at issue. LeadDesk is not liable for indirect, incidental, or consequential damages.

9. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify registered users of material changes by email.
